  In the year of 2005, ACPAA carried out numerous activities and projects. Now I would like to briefly introduce to you some of our leading events in 2005:

· Profession Administration
     According to the principles of our association, namely, for the aims to unify and instruct our members to abide by the Constitution, laws, regulations, national policies and social moralities; to stick to the professionalism, scrupulously abide by the professional moralities and disciplines; to coordinate internal and external relationships, protect the rights and interests of our members, and improve the quality of their practices; to enhance the self-discipline, prohibit unfair competitions, and lead the development in a healthy way. In the year of 2005, we have carried out following activities:

  1. On May 27, 2005, we held the 5th Session of 6th National Congress of All-China Patent Agents Association in Beijing. There are more than 100 members participated in this meeting.
  2. According to the resolution made by Council of our ACPAA, we held a meeting on June 15, 2005 with 115 foreign-related patent agencies. On the meeting, we announced the resolution regarding the adjustment of “Schedule of Fees for Chinese Patent”. This resolution came into force on July 1st, 2005, which formulated a new RMB based criteria for the foreign-related patent agencies in China.
  3. In 2005, we held separately symposiums in Guangdong province, Shanxi province, Sichuan province, Shanghai, and Jiangsu province with the relevant leading representatives patent agencies in these 6 provinces. On the meeting, the General Secretary Mr. YUAN De made a report about the recent works of ACPAA, and heeded the opinions on the amendment of “Patent Agent Regulations”. We listened to the appeals of the patent agents so as to better protect their interests. These symposiums marked our new way of cooperation with the local administrative patent offices around China.
  4. In August 2005, the 9th Session of 6th Council of ACPAA was held in Beijing.
  5. On August 30, 2005, we organized a meeting with the Education, Science, Culture & Health Department of the Legislative Affairs Office of the State Council, to discuss the amendment of “Patent Agent Regulations”. Mr. YUAN De, the General Secretary, reported the collected opinions and suggestions regarding the amendment of Patent Agent Regulations. The President Mr. GAO Lulin and Vice-President Mr. WU Bingfen of ACPAA also gave their proposals regarding this issue on the meeting.

· International Communications
     We have attached great importance to cooperate with other organizations around the globe. In 2005, we mainly organized following events:

  1. On March 3rd, 2005, the Japanese Patent Attorneys Association Delegation led by Mr. Ji Tian, which has 26 delegates visited ACPAA, and General Secretary Mr. YUAN De accompanied them visited the China Customs and State Intellectual Property Office of China.
  2. On March 8, 2005, invited by Korean Patent Agents Association, we organized a delegation to participate in the Korea-China Executive Meeting and Korea-Japan-China Tri-lateral Meeting in Korea.
  3. Invited by IP Branch of American Bar Association (ABA), we organized a delegation, which led by President GAO Lunlin and General Secretary YUAN De, visited San Francisco, Los Angels, Washington, New York to discuss with the relevant official departments, law firms and other professional societies. The visit is completely successful.
  4. On June 10, 2005, together with Japanese Patent Attorneys Association, we successfully held a Seminar regarding IPR protection in Beijing. The seminar is mainly focused on “the principles of patent infringement judgement”, “the trend of patent infringement litigation”, and other hot topics such as “Patent examination rules of the computer programs” and “Judgement comparison of the protection of design”. The leaders from State Intellectual Property of China also met the delegates and made a presentation at the opening ceremony.
  5. On June 27, 2005, Mr. Jue Bu Mao Yuan from Japanese Translation Association visited our association.

On July 12, 2005, Mr. Johan Amand, the Director of International Affairs Department of European Patent Office, and Mr. Pedro Osona and Ms. Myriam Leveque from China Cooperation programme of EPO, visited our association and held a meeting with Secretary General Mr. YUAN De for future cooperation.
  8. On June 6, 2005, we signed a contract with European Commission (EC) to implement a project entitled “Comprehensive Programme of Patent Enforcement Support in China”. This project is mainly financed by “EU-China Small Projects Facility Programme” and implemented jointly by ACPAA and EPO. The project was started on July 1, 2005, and its duration is 9 months. The project includes following 3 activities:
    1. To study and learn the experiences regarding the Patent legislation, training of the patent agents and examination and management system, we will organize a delegation to visit Germany, France and UK. The delegates will include the officials from Legislative Affairs Office of the State Council of China, State Intellectual Property Office of China, and All-China Patent Agents Association. They will visit European Patent Office, European Patent Institute, Max-Planck-Institute, International Patent Attorney Association, French Patent Office, British Patent Office and other organizations.
    2. In Beijing, we will organize a training course for senior managers of patent agencies. The topic of this seminar includes European and Chinese IPR law firms and patent litigation procedures; Human resources’ development and management of Patent agencies; Stock management, performance management and profits distribution within patent agency partnerships.
    3. In Guangzhou, we will organize a training course on the topic relating to Patent infringement. This seminar will focus on the new judicial interpretation of Supreme Court of the People’s Republic of China on patent infringement, international patent litigation and how to effectively prohibit the patent infringement.
    4. In Shanghai we will organize a training course regarding the patent licensing. We will invite experts from both China and abroad to introduce relevant knowledge and experiences regarding the patent licensing so as to improve the IP attorney’s ability to ensure proper compliance with licensing agreements.

· Training and Professional Study

  1. Under the jointly effort of Japanese Translation Association and ACPAA, China-Japan IP Translation Training Course was held in Beijing from Oct, 2004 to Jan, 2005.
  2. The patent business seminar for Chinese patent agents was held in Beijing and Shanghai on Feb.21,2005, which organized by The Association for Overseas Technical Scholarship (AOTS) and undertook by ACPAA, and got finance assistance by JETRO (Japan External Trade Organization).
  3. The April of 2005, the ACPAA organized a exam committee and set up selection principles for sending Chinese patent agents to Japanese law firms for 3 months, finally 3 excellent patent agents were selected by the principle from 100 students of “China – Japan IP translation training course”. They will study related patent business and management experience in Japanese law firms and introduce Chinese IP system to Japanese Colleagues.
  4. ACPAA organized 3 training courses for new patent agents before taking up post in 3 quarters of 2005; about 450 qualified patent agents attended the training courses.
  5. On July of 2005, ACPAA held a “patent practice training course especially for western region” in the Xi An city of ShanXi Province, and on Aug, 2005, hold an other “patent practice training course” in Wei Hai City of ShanDong Province. The content of training related to how to write patent application on biology technology, computer program, as well as reexamination and novelty invalid cases and evidences technical judgment, patent infringement judgment principle etc. These topics were welcomed by patent agents.
  6. On Sep.19-20, 2005, the<< 14th China-Japan IP Seminar >> was held in the ChengDu, Sichuan Province, the seminar was organized by ACPAA and JITPA (International Trade Promotion Association), assistanced by local IP Administrative Bureau. The topic of the seminar is IP stratagem for enterprises and patent infringement judgment. Totally 137 participants joined the seminar.
  7. On Oct.31, 2005, a training course for Chinese Senior executives of Patent agencies will open in Beijing, more than 100 senior managers in Chinese patent agents will attend the seminar.
  8. Establishing Patent academy committee. By the decision of 8th session of 6th the council of ACPAA, Patent academy committee was established, it comprise 5 subcommittee, they are patent of invention, utility model, design, international IP law, IP litigation, as well as a study group for revision of patent agent regulation.
  9. In Nov. 2005, ACPAA will hold a communication meeting between patent agents and examiners of SIPO.
  10. A magazine called is edited and published quarterly by ACPAA.
